Just a hunch with the recent law suit against Pornhub and Mindgeek, where Visa and Mastercard have decided to abandon processing for them.I see user uploaded content sites going downhill and a new model has to crop up to fill the void.

Yep Mastercard's new rules means that you really cant have ANY user uploaded content anymore if you want to accept credit card payments on your site

Now you need to have consent forms, IDs, model releases etc for everything.

Its a bit of a mess actually because although Mastercard says you must have all these forms, the European Data Protection Act says you cant share that information with anybody !

Pornhub may have won their legal battle but they have still lost their merchant account and the site is dying as a result

If you guys are talking about the case in this Thread where the judge did not grant the request by Visa to be removed form the case then nothing has been ruled in favour of or against Pornhub and Mindgeek, the case is progressing.

This could be a slippery slope as there is a much bigger picture here

If pornhub are found to be liable for content someone uploaded to their site, then by extension Facebook, Twitter, Youtube, Instagram and pretty much ALL social media sites could be held liable for any content posted with them and thats where the problem is

Social Media sites do police their content as much as possible and obviously illegal stuff (kids etc) should be blocked from the start but apart from that, how is a site supposed to know if the person in the pic has given their consent ? Or is under the influence of alcohol ? Or if its revenge porn ? etc

You cant expect every social media user to provide written documentation and IDs etc with every pic or video they want to share.

Politicians have been trying to hold social media sites liable for years and if they ever succeeded then that would be the end of social media. Thankfully most politicians realise that if they tried to end social media then they would be voted out in a heart beat

But this case could well set a precedent
